EL PASO, Texas -- The Luis Posada Carriles perjury trial resumed Friday, after two days of bad weather that closed the courthouse, and the Cuban exile militant quickly scored a victory when the federal judge in the case excluded a key piece of evidence.
U.S. District Judge Kathleen Cardone ruled that a Guatemalan passport issued to Posada under a different name cannot be presented at trial because federal prosecutors did not properly authenticate the contents of the passport, such as how Posada's picture came to be on the document or who stamped the visas on it.
The ruling was a setback for the prosecution. The passport is a key piece of evidence in the trial against Posada; one of the main charges is that the defendant lied about being in possession of a Guatemalan passport issued in the name Manuel Enrique Castillo López.
