The Missouri Court of Appeals ruled Tuesday against a utility company over whether it needed the approval of a county zoning board before it built a $140 million power plant outside Kansas City, Mo.
The decision could force Aguila Inc. to tear down its South Harper power plant near Peculiar, Mo., which was built without going through the Cass Coiunty zoning process.
The decision continues a string of legal victories for Cass County, though the final decision will likely come from the Missouri Supreme Court. The court's decision rejected arguments from the state's public service commission that it had the authority to approve power plants without regard to regulations.
