GULFPORT — The landmark Katrina insurance case, Corban vs. USAA, has been settled on undisclosed terms.
Biloxi attorney Judy Guice, who represents Margaret and Magruder S. Corban of Long Beach, confirmed the settlement this morning.
She declined to comment further. The case had been set for trial Monday in Circuit Court.
Before trial, Judge Lisa Dodson sent the case to the Mississippi Supreme Court for a ruling on whether the anti-concurrent causation clause applies to hurricane losses. Some insurance companies interpreted the clause to mean that wind damage is not covered when tidal surge, covered under federal flood policies, contributes to the loss.
