A lawsuit brought last week by a Chapin High School student to compel Gov. Mark Sanford to tap $700 million in disputed federal stimulus money is flawed and premature, according to a response to the lawsuit released Monday morning by S.C. Attorney General Henry McMaster.
Casey Edwards, 18, filed a lawsuit asking the S.C. Supreme Court to decide who - Gov. Sanford or the Legislature - controls the federal money.
In an indication it could act swiftly, the court ordered McMaster to respond to the lawsuit by 1 p.m. today. McMaster said the standoff between lawmakers and the governor needs more time to develop before courts can weigh in to settle the dispute. Right now, the attorney general said, the dispute is still a public policy debate and not yet a legal dispute.
A legal collision seems likely, however.
