Fayette Circuit Judge Thomas Clark stopped a psychological evaluation of former state Rep. Steve Nunn, who is charged with murder in the Sept. 11 death of his ex-fiancee.
Clark's Friday morning decision to set aside his earlier order for an evaluation will return Nunn to the Fayette County jail.
The order had previously been requested by Nunn's attorney and prosecutors had not opposed it. The order had sent Nunn Tuesday to the Kentucky Correctional Psychiatric Center in La Grange for a 30-day psychiatric evaluation.
Nunn, 56, is accused of fatally shooting Amanda Ross in Lexington. He has pleaded not guilty.
Commonwealth's Attorney Ray Larson had filed the motion to stop the evaluation Thursday because a grand jury had not yet returned an indictment.
Nunn's attorney, Astrida Lemkins, told Clark that Larson had filed his motion to vacate the order late and she considered that "not fair."
