The Minnesota Court of Appeals was fully engaged Wednesday as it heard Sen. Larry Craig’s attempt to withdraw his guilty plea, but sent no clear signal on how it might rule, according to former Idaho Attorney General David Leroy.
“I don’t think anybody from viewing the argument can guess what the outcome will be,” said Leroy, who watched the hearing on a television feed.
Leroy said the argument focused almost entirely on the procedure of Craig’s plea and largely ignored constitutional questions, including issues raised by the American Civil Liberties Union on Craig’s behalf. Nor did the notoriety of the case come up.
“This was not argued as a celebrity case,” said Leroy, a Republican. “The senator’s status, or his loss of livelihood or reputation was not mentioned at all. It was just another case that focused on the technical and procedural side of a guilty plea.”
